Tackling Delays in Elective Care in the NHS

Can You Sue The NHS For Compensation?Excessive waiting times for procedures, diagnoses and treatment are a serious issue within the NHS which the government is looking to tackle.

New government approach to elective care

The government has this week published its 'Reforming Elective Care for Patients' plan, acknowledging the scale of the problem of waiting times for non-emergency care and procedures.

Identifying that, although the standards set an expectation that 92% of patients should not have to wait for more than 18 weeks from referral to treatment, the current reality is that over 2 million patient waits currently exceed that time and that in some areas, cancer waiting times have not been met for more than 5 years.

The plan proposes to achieve its aim through the following approaches:

  • Empowering patients through choice and control, increasing availability and use of the NHS app and 'Manage Your Referral' website
  • Reforming delivery through the launch of 17 new or expanded surgical hubs and increasing the availability and hours of Community Diagnostic Centres
  • Ensuring that appropriate care is provided in the appropriate place by encouraging the use by medical practitioners of the NHS 'Advice and Guidance' service to provide specialist advice as to patient care pathways
  • Aligning funding, performance and delivery

Medical negligence in elective care

Timely provision of appointments, referrals, tests, scans, diagnoses and treatment is often crucial to the long-term health of the patient.

Receiving the appropriate care from suitably-experienced professionals is likewise essential to the best outcome.

Delays can cause devastating problems for the patient. For those many patients whose care is delayed, the impact can be life-changing.

Where appropriate it may be possible to make a claim for compensation.

A successful claim will address the financial losses experienced by the patient as a result of the negligence which they have suffered. This may include a loss of income if the patient is now struggling to work or has had to change careers due to the nature of their symptoms.
