NHS Compensation Claims Guide

female medical negligence claims victimIf you are thinking of making a claim for compensation for medical negligence, the best advice we can give you is to make sure that you have the support of an expert in medical negligence law. These claims are fiendishly complicated and the guidance of a specialist is an absolute necessity.

The first steps in making your claim

In the first instance, your solicitor will want to hear your description of what occurred to you and why you believe that you may have been the victim of negligent medical care. It is helpful if you can be as clear, accurate and comprehensive as possible in your account in order to assist the solicitor in producing your witness statement of events.

Obviously, the sooner you undertake this task, the more accurate your memory and your account is likely to be. If you think you may have been the victim of negligent care, don't delay before contacting a medical negligence legal specialist.

Analysing your care

If the solicitor agrees to assist you with your claim, they will ask for your signed authorisation to obtain your medical records.

They will then instruct the best medical experts to analyse your medical records and assess the quality of your medical care. The purpose of this is to ascertain whether or not there was a breach of duty during the course of your medical care and whether any negligence or substandard care has caused you to suffer a worse outcome than would have been the case with an acceptable level of care.

It may be necessary as part of this process for you to attend appointments with one or more medical experts for an assessment of your condition and prognosis with a view to determining how you have been impacted by any negligence.

Pursuing the claim

If it is found that you have indeed been the victim of negligent medical care, and that it has caused you to suffer symptoms and consequences which would not otherwise have been the case, your solicitor will assess the nature of the consequences and the financial losses which you have suffered. This may, for example, include a loss of income if you are now restricted in the type of work you can undertake or the hours you can manage.

It may also include the costs of care or equipment or household adaptations necessary to assist you in coping with any difficulties caused by your negligent care.

Specialist legal advice

A solicitor who specialises in medical negligence law will not only have the experience to assess and manage your claim, they will also have the expertise to negotiate the best settlement.
