Suing the NHS for Negligent Knee Surgery

Post-operative infection

One of the most common and debilitating side-effects of knee surgery is the development of post-operative infection. Not only can this trigger a sepsis response which can be life-threatening, but it can also require the removal of the replacement knee in order to resolve the infection.

If the infection is found to have been caused by medical negligence, and causes significant and on-going problems, then it may be appropriate to make a claim for compensation.

It may be that an 'at risk' patient has not been given prophylactic antibiotics, allowing their system to succumb to infection.

It may be that the care of the patient following surgery was inadequate and the signs and symptoms of an incipient infection were not noticed.

Deep vein thrombosis

Patients undergoing knee surgery are at risk of developing deep vein thrombosis. If a patient is considered to be at risk and no preventative action is taken by medical professionals, they may be regarded as having provided substandard care. If the patient subsequently suffers long-term symptoms due to DVT, a compensation claim may be a helpful way forward.

Compartment syndrome

An occasional complication of knee surgery is compartment syndrome which, if unrecognised, can lead to long-term disability.

During extended surgery, pressure within the muscle compartment can increase to the point where blood flow is compromised and muscle and nerve damage can occur.

If the unfortunate outcome is caused by a failure of caution during the surgical period, it may be appropriate to claim compensation for the pain, suffering and financial losses of the patient.
