Sight Loss and Medical Negligence Claims

Sudden loss of sight is a traumatic and life-changing experience. If this has happened because of negligent medical care, it may be appropriate to make a claim for compensation.

Claiming compensation for sight loss

In order to make a claim for compensation for sight loss, it is necessary to be able to prove that the actions of the medical professional were in some way negligent and that the negligence has caused the patient to suffer debilitating symptoms which would not have otherwise developed.

A successful claim will take into account any financial losses which you may have suffered as a result of the negligence. For example, it may be that you are no longer able to work and have suffered a significant loss of income. It may also be the case that you now require assistance around the home and those costs would be taken into account also.

Sight loss and medical negligence

Negligent sight loss may occur for a number of reasons including the following:

  • Inappropriate positioning during prolonged surgery
  • Poor surgical technique or accidental error
  • Delayed diagnosis and treatment of a condition relating to the eye, the optic nerve and the brain
  • Incorrect prescription or administration of a drug
  • A 'Never Event' such as surgery on the wrong eye, or even on the wrong patient

Damage to a person's vision can sometimes occur in relation to conditions that are unrelated to the eye.

Negligent sinus surgery, for example, can lead to sight problems and visual disturbances if the muscles or nerves around the eye are mistakenly damaged during a sinus procedure.

Another example of sight-related medical negligence would be delayed diagnosis of a tumour in the brain or delayed treatment of excess cerebrospinal fluid, leading to increased pressure on the brain and damage to the visual function.

A delay in the diagnosis of sepsis can also leave the patient with impaired vision.
