Post-operative Problems and When to Claim Compensation

Post-operative Problems and When to Claim CompensationIf you or a loved one are facing significant challenges following a problem during or linked to a surgical procedure, talk to a legal specialist about the possibility of making a claim for compensation.

Errors in surgery and surgical procedures

Symptoms and difficulties following surgery can arise for a wide range of reasons. They may be the anticipated and unavoidable problems related to the nature of your surgery. They may be a known risk. They may be short-term or long-term. However, they may also be negligent, unanticipated and life-changing.

Not surprisingly, due to the complex and varied nature of many surgical procedures, errors can occur in many different ways including the following:

  • An error during surgery such as accidental damage to a nerve or organ close to the surgical site
  • An error of positioning, causing nerve damage or compartment syndrome
  • An error of anaesthesia
  • An error of infection control, allowing the patient to develop severe infection or sepsis
  • An 'never event' such as using an incorrect prosthesis or leaving an item of surgical equipment inside the patient after surgery is completed

Any of these shocking failings on the part of medical professionals can cause the patient to suffer permanent and debilitating symptoms and difficulties. This can range from loss of function in some parts of the body, the loss of mobility, the need for additional surgery, and long-term poor health and reduced quality of life.

When to claim compensation

In the first place, it is important to be aware that, if you suspect that either you or a loved one have been the victim of negligent care and are considering making a claim for compensation, you need to act promptly. These claims are associated with a three-year deadline from the date of the alleged negligence and the quality of your medical care will need to be investigated before this deadline.

In terms of your entitlement to make a claim, it will need to be clear both that an act of negligence or breach of duty did, in fact, occur during the course of your surgical procedure, and that the negligence caused you to suffer a worse outcome and symptoms than would have been the case with an appropriate, non-negligent level of care. A specialist solicitor will undertake an investigation into the quality of your care.
