Plastic Surgery Negligence

When you elect to undergo a plastic surgery procedure, you put a huge amount of trust into your surgeon. That is why if something goes wrong, you will be left feeling very distressed, and will most likely be facing physical, emotional and financial trauma.

Plastic Surgery and Medical Negligence

Plastic surgery is increasing in popularity, with number continuing to grow. More often than not, these procedures are carried out with expert skill and attention, leaving someone with results they can be happy with.

However, unfortunately there are times in which the level of treatment provided by plastic surgeons falls below an acceptable standard. Measures have been taken to try to minimise such events. Most notably, since April 2002 all surgeons specialising in plastic surgery must register with the General Medical Council (GMC). This allows a patient to be sure their surgeon has had specialist training. Even so, plastic surgeons registered before April 2002 do not have to submit their name to the GMC, and therefore can remain unregulated.

Nevertheless, whether registered with the GMC or not, all medical professionals have a duty of care towards their patients – both in the private sector and in the NHS. If there is a failure to meet this duty of care, and a patient suffers as a result, then there may be a case of medical negligence. If so, it will be possible to make a medical negligence claim.

What Can You Claim For?

We have over 25 years experience in dealing with medical negligence claims. This gives us the resources and professional expertise to pursue claims for all types of negligent plastic surgery which (amongst other things) may arise from:

  • Excessive scarring;
  • Uneven results – eg. lopsided breasts after an augmentation/reduction;
  • Infection;
  • Nerve damage;
  • Loss of function.

We are happy to deal with all forms of plastic surgery negligence, some of the most common of which include: breast augmentation, breast reduction, rhinoplasty (nose job), chin lift, face lift, eye lift, tummy tuck (abdominoplasty) and genital cosmetic surgery.

Where To Start?

If your plastic surgery operation has produced the results you had hoped for, you will understandably be feeling very upset. Indeed, problems resulting from negligent plastic surgery can not only have a detrimental impact on a person physically, but can also cause emotional trauma, not to mention significant financial damage.

So if you feel your plastic surgery has gone wrong, and that this was the fault of your medical team, what exactly can you do?

The first step is to contact a medical negligence solicitor. They will be able to discuss the nature of your treatment with you before advising on the best course of action. If it is possible to pursue a claim, your solicitor will explain how the process works, keeping you well-informed every step of the way.

Should your claim be successful, you will receive compensation for your injuries. This will cover general damages, which relates to the pain, suffering and loss of amenity you have experienced as a result the negligent treatment. The sum of compensation will also include special damages, such as a loss of earnings or medical expenses.

Remember, you only have three years to make a claim, starting from when the negligent treatment occurred. It is therefore vital not to delay when seeking legal assistance.
