Patient Safety Review 2024 and Compensation for On-going Negligence
The recent annual report of the Patient Safety Commissioner highlights the need for this important role, the successes achieved so far, and the strategy for a future focus.
Patient Safety 2023 - 2024
The report emphasis the fundamental need within the healthcare system to 'keep patients safe from avoidable harm' and notes that 'key to the task of reducing the toll of harm is involving patients and their families.'
The role of the Patient Safety Commissioner, established in 2022, is to ensure that the voices of patients are heard.
The report identifies the success achieved so far in relation to addressing issues related to sodium valproate medication and pelvic mesh.
Furthermore, the PSC has been instrumental in the recent introduction of Martha's Rule ensuring a response to patient concerns regarding their deterioration.
Future plans
The report identifies the issues which will be prioritised over the next year.
These are described as the following:
- To drive the alignment of the healthcare system to deliver a just and learning safety culture
- To support initiatives that amplify all patient voices and empower patients to make informed decisions about their care
- To advocate for partnerships that embed patient safety and patient voice throughout the healthcare system
It also notes an intention to overhaul the complaints process and clinical negligence, 'ensuring that when something goes wrong with a medicine or medical device, patients receive a non-adversarial response.'
On-going negligence
Every improvement in ensuring and maintaining patient safety within the healthcare system is to be welcomed. Every patient who enters the system will have serious concerns and has a right to have their voice heard.
Inevitably, however, errors continue to occur. Within such a vast system as the NHS and with the thousands of procedures, consultations, referrals and prescriptions that take place every day, mistakes occasionally occur and, when the patient suffers as a result, they continue to be entitled to claim compensation for the consequences.
This remains the case whether the incident occurs in the GP surgery or in the hospital, whether it is on the phone to NHS 111 or in the response provided by the Out-Of-Hours service.
