Patient Safety and the NHS 10 Year Plan For England
The government’s new 10-Year plan for the NHS recognises the problem of errors and harm occurring to patients within the healthcare system.
It states that 'the NHS' history is blighted by examples of systematic and avoidable harm' and links this to 'a fundamental lack of transparency', in response pledging to make the NHS 'the most transparent healthcare system in the world.'
Plans to address the issue of patient safety include an aim to 'reform the complaints process and improve response times to patient safety incidents' as well as planning to 'review how to improve patients' experience of clinical negligence claims.'
Specifically, addressing long-term concerns about maternity services at many Health Trusts across the country, the new plan will 'set up a national independent investigation into maternity and neonatal services'.
The number of inquiries we receive related not only to maternity care, but emerging from a wide range of medical specialties including oncology, orthopaedics, infection control and nerve damage, is testament to avoidable harm being a very real and on-going issue within England's healthcare system.
The cost of such harm, both in terms of its impact on the patient's quality of life but also in terms of the financial impact on the NHS of addressing claims for compensation, is considerable.
The need for reform and the reduction of harm is evident but, in the meantime, patients who have suffered due to negligent care need to know that they have a route to recover their losses and recognition of the damage they have suffered.
Recovering compensation
Legally, a patient who suffers harm due to negligent care within the NHS, whether at hospital or in the GP surgery, is entitled to claim compensation for the impact of that harm, insofar as it was caused by the negligence.
If you or a loved one are struggling with the consequences of negligent medical care, speak to a specialist in medical negligence law to discover whether or not you are entitled to make a claim.
A successful claim will address the financial consequences of the negligent care. This can include a loss of income if the patient is no longer able to work or is restricted in what they can now earn due to the nature or severity of their symptoms. It could also include the costs of care or equipment necessary due to the impact of the negligent care.
