Negligent Nerve Injury Compensation

Nerve damage can cause permanent dysfunction and, where it is a result of medical negligence, it may be suitable to make a claim for compensation.

The body's vast and complex network of nerves is fundamental to our ability to function. Our nerves recognise both external and internal stimuli and inform the brain about what is happening to and around us. Furthermore, they carry messages from the brain to various muscles around the body to initiate function and movement. If the nerves are damaged, parts of the body may cease to function. If that nerve damage is caused by medical negligence, it may be appropriate to make a claim for compensation for the loss of function and the ways in which it has affected the patient's life.

A wide variety of medical procedures can cause unintended nerve damage, causing the patient to suffer lifelong disability.

Orthopaedic surgery

Both hip replacements and knee replacements offer the opportunity for damage to the local nerves.

The femoral nerve, which travels from the lower spine and through the pelvic region to the legs, is at risk of damage during a hip replacement. It is key to both sensation and movement in the leg and a loss of function can cause loss of mobility or a risk of falling.

Damage to the peroneal nerve during a knee replacement can lead to foot drop and loss of ankle reflexes, again causing reductions in the patient's ability to mobilise.

Spinal Surgery

The central nervous system includes the nerves which run from the brain through the spinal canal before branching out to all parts of the body.

During spinal surgery there is a risk that the nerves in the spinal canal will be damaged, potentially affecting a wide range of parts of the body and associated function.

Obstetrics and Gynaecology

Procedures such as a caesarean section or a hysterectomy also present a risk to the nerves and it is possible for loss of bladder function, for example, to occur as a result.

Nerves may recover from damage or function may be permanently lost.

Where severe damage is a product of medical negligence, it may be appropriate to make a claim for compensation for the long-term impact and financial losses.
