Misdiagnosis Medical Negligence and How to Claim Compensation

Can You Sue The NHS For Compensation?A misdiagnosis of a patient's symptoms can have a range of unforeseen and debilitating consequences. At worst, the consequences can be life-threatening. If you or a loved one have suffered from the impact of an incorrect diagnosis, contact Glynns Solicitors to talk about the possibility of claiming compensation.

The implications of a medical misdiagnosis

A misdiagnosis can close the door to other possible interpretations of the patient's symptoms in a variety of ways:

  • Providing reassurance to the patient, which is not justified, that their condition has been recognised and is receiving the appropriate response, whether that is a referral, medication or no further action. This can mean that the patient does not seek further medical help if their condition changes and the correct course of action is delayed
  • Following a misdiagnosis, it may be that an urgent or emergency referral for specialist investigation, testing or intervention is not made, allowing time for the patient's condition to worsen
  • The patient may be commenced on medication or on a treatment pathway that is entirely unsuited to their needs, possibly making their condition worse

The fundamental problem is that a correct diagnosis has not been made. If there has been an element of doubt in the mind of the medical professional, it has not been pursued by seeking a second opinion or specialist advice. The patient has been given an incorrect diagnosis.

The actions needed to respond to their actual condition have not been instigated and the clock has started ticking. In some cases, a delay may not be critical. Where other conditions are concerned, however, a delay even of a few hours or days, can be life-changing. The patient's condition may alter to such an extent that their long-term outcome can be dramatically different to what could have been the case with a competent and appropriate medical response.
