The right to compensation for medical negligence

Legally, a patient is entitled to make a claim for compensation if it is found that there has been an act of negligence or substandard care by a medical professional which has caused the patient to suffer a worse outcome than would have been the case with an acceptable and appropriate level of care.

In some circumstances, however, it may not become apparent until a later date that the patient has been the victim of a 'never event'. For example, if an item of surgical equipment has been left inside the patient's body and it is only after investigation of unexplained symptoms that the situation becomes clear.

In order to establish whether or not a never event has occurred and what impact it has had on the patient, if any, it is necessary for the patient's medical records to be analysed by medical experts. If they can identify that a never event has, indeed, occurred, they will assess what effect this has had on the patient's outcome.
