Once we have agreed a contract with you and obtained your formal instructions and authorisation to act on your behalf, we will begin to investigate and pursue your claim.

Pursuing your claim on your behalf

As you can imagine, medical negligence claims require careful and thorough investigation. Detailed assessment is needed of the events related to your negligence and its impact on you. Our work on your behalf will include the following:

  • Witness statements – we will prepare witness statements with yourself and any other relevant parties to identify the circumstances of your claim and its impact
  • Medical records/experts – we will review your medical records and obtain opinions from relevant experts as to the details and impact of your medical experience and your on-going prognosis
  • Financial losses - We will agree with you what financial losses you have incurred as a result of the medical negligence you have experienced
  • Future care and losses – we will obtain evidence as to what future care you may require and what future losses you may incur due to the medical negligence

  • Trial – if settlement with your opponent proves impossible we will deal with all actions necessary to take your case to court where it will be assessed by a judge.
  • Covering the costs of your claim - we will obtain insurance on your behalf to cover the payment of costs in the event that your case is lost

How long does a medical negligence claim take?

Medical negligence cases tend to be complicated and lengthy, often taking several years before a settlement is reached. Arguments as to whether negligence occurred and, if so, what its impact was, can be protracted.

You may need to have appointments for assessment with a variety of medical experts who will then produce detailed reports on your case to support the negotiation process.

Also, the long-term outcome of your medical negligence may not be clear at the start of your case and it may be necessary to wait until there is greater clarity as to what the future impact on you will be before agreement as to the level of compensation, if any, can be reached.
