Making a Compensation Claim for a Never Event

Making a Compensation Claim for a Never Event

If you have suffered a 'never event' in hospital which has had a significant impact on your life, it may be appropriate to make a claim for compensation. Contact Glynns Solicitors today.

Never Events

A 'Never Event', quite simply, is an occurrence during health care which should never happen. It could include a wide variety of events such as the accidental misadministration of medication, carrying out a surgical procedure to the incorrect part of the body and leaving a surgical instrument or a piece of equipment in the patient's body after surgery.

Although such events seem highly unlikely and are, in fact, fairly rare, they do happen and the long-term impact on the patient can be devastating. Where incorrect or negligent surgery is concerned, for example, it is likely that the patient, as a result of the negligence, will have to undergo further surgery with all the associated risks in order to rectify the initial mistake. A retained object may need to be removed or surgery carried out on the correct part of the body.

Where a piece of equipment such as a swab has been left in the body it may cause infection as well as discomfort. Where a clip or a surgical instrument has been left inside the patient's body, it may cause significant damage to surrounding structures and features of the body.

The impact of a medical 'never event'

'Never events', where they cause long-term problems, may justify the patient in making a claim for compensation. The patient may find, for example, that their quality of life and their ability to earn an income may have been compromised by the accidental, but nonetheless significant, negligence.

By its very nature, where a 'never event' has occurred, it is clear that an act of negligence has taken place. It is not a standard quality of care for a patient to be left with a surgical instrument inside them or to have a surgical procedure carried out on the incorrect part of the body.

If the negligence has caused significant, on-going problems for the patient, a compensation claim might be a helpful way forward, providing recompense for the pain and suffering as well as any financial losses associated with the incident. Where the patient is unable to work due to the effects of the negligence, for example, a successful compensation claim should include those income losses.
