Making a Claim for Substandard Medical Care

Making a Claim for Substandard Medical CareSubstandard medical care may justify a claim for compensation. What is it and when is it appropriate to make a claim?

What is substandard care?

Substandard or negligent medical care is a level of care which does not meet the standard that one should expect of a medical professional in a particular situation. It may relate to a variety of medical procedures including examination, risk assessment, consent, diagnosis, prescription and administration of medication, safety-netting, test referrals and interpretation, and negligence during a surgical procedure.

Negligent care does not necessarily justify a claim for compensation. You need to be able to demonstrate that the negligence caused you or your loved one to suffer a worse outcome than should have been the case with an appropriate level of care.

When to make a claim

Firstly, it is important to remember that claims for compensation for medical negligence are not open-ended. There is a deadline of three years after the negligence by which a claim has to be issued with a court and an investigation into the quality of your medical care needs to be carried out prior to that deadline. So if you think that either you or a loved one may be entitled to make a claim, ensure that you contact a specialist solicitor for advice at the earliest possible moment.

A legal specialist will obtain copies of your medical records and arrange for the most respected medical experts to analyse the quality of your medical care. It will be their job to identify whether or not you have been the victim of negligent medical care and, if so, how and to what extent, if any, the negligence affected your long-term outcome. If it appears that you are suffering symptoms and associated difficulties because of an act of negligence, you should be entitled to make a claim.
