Joint Replacement Problems and the Possibility of Compensation

Joint Replacement Problems and the Possibility of CompensationIf you have undergone joint replacement surgery and are now struggling with significant on-going problems, you may wish to consider whether you have been the victim of negligent medical care.

If this turns out to be the case, it may be possible to make a claim for compensation.

Errors in joint replacement surgery

There are three main areas of possible negligence in relation to a joint replacement which has the potential to cause life-changing consequences for the patient:

  • A surgical error relating to the actual procedure may have occurred - this could be the use of an incorrect implant or the incorrect positioning of an implant, causing the patient to require additional surgery and possibly compromising their mobility on a permanent basis
  • A nerve in the vicinity of the point, such as the femoral nerve in the case of a hip replacement, may be inadvertently damaged, again compromising the patient's long term mobility
  • An infection in the joint may occur if a pre-operative risk assessment has not been carried out or implemented or is insufficient monitoring or healthcare has left the patient vulnerable to the development of infection. An infection may require the reversal of the surgery, may necessitate further surgery and may trigger sepsis, compromising the long-term health of the patient

Facing the consequences

The consequences of a failure in the course of joint replacement surgery can vary according to the nature of the error and the responses of the medical professionals involved.

Unfortunately, such errors can leave the patient with permanent disability which may be worse than the problems which prompted the surgery in the first place.

The individual affected may find that they are no longer able to work and that they have become reliant on personal care. Their home may need to be adapted to suit their new needs.

If such appalling consequences are considered to be the result of negligent medical care, the patient would be legally entitled to make a claim for compensation which would address financial losses such as a loss of income.
