How To Start a Medical Negligence Compensation Claim

If you or a loved one have been adversely affected by negligent medical care, you are legally entitled to make a claim for compensation.

But, how to go about it?

There are two important factors to consider:

  • 1) Do you suspect that there was a breach of duty in the course of your medical care, such as a failure of care, an accidental mistake, a misdiagnosis or a delay in treatment?
  • 2) Have you suffered a worse outcome following the substandard care than would have been the case with an acceptable level of care?

If the answer to the both of the above is 'yes', then you may be able to make a claim for compensation. A successful claim would take account of any financial losses you have suffered as a result of poor care such as a reduced income or costs for extra help around the home.

Where to start?

Pursuing a compensation claim for negligent medical care is a complex legal process. You would be best advised to obtain the services of a specialist lawyer. They will have the expertise, experience and contacts to make the most accurate assessment of the quality of your care, to engage the best medical experts to evaluate your case and have the skills to negotiate the best outcome for you.

Getting started

Once a solicitor has agreed to take on your case, you will need to authorise them to obtain your medical records so that an assessment of the quality of your care can be carried out. This will clarify whether or not a breach of duty has occurred and whether you have a claim for compensation.

Medical experts will also be instructed to assess the impact that any negligent care has had on you and its continuing impact into the future.

You will also be asked to describe the events which occurred in order to produce a witness statement.

The first step

The first step is to find the right solicitor. It is important to be aware that compensation claims for medical negligence must be initiated within three years of the date of the alleged negligence. This is not the date by which you engage a solicitor. This is the date by which your claim is issued and a solicitor will need plenty of time before this date to assess the quality of your care and its impact on you.

So don't delay.
