How do I make a complaint against the NHS?

If you would like to make a complaint against the NHS, you can do so by writing a formal complaint to your GP surgery's practice manager. Or if you are complaint about a hospital, you can ask for a complaints form or (in most cases) submit a complaint online. The Patient Advice and Liaison Services (PALs) located in each Trust will be able help you, should you want assistance.

If you make a complaint, it must be investigated and a response given to you within a certain amount of time. The doctor or organisation will not necessarily apologise or admit failings. If you are not happy with the response, you can take the matter to the Parliamentary and Health Service Ombudsman.

The Ombudsman is an independent body who will investigate your complaint and the way the hospital/organisation dealt with it. Again, this does not mean you will receive an apology or any other sort of compensation.

How do I sue the NHS?

But if you want to sue the NHS, you need to ask a solicitor to help you. In particular, you need a solicitor who specialises in medical negligence claims (also called clinical negligence claims in England and Wales).

Suing the NHS is different to make a complaint. The process is much longer and involves civil litigation, meaning it must be taken through the court system. Very few cases actually go to trial, although there is a small possibility this could happen.

Because it is a legal process, you need a lawyer to assist you. Your solicitor will build a case against the clinician/hospital/organisation in question. In some claims, the negligent party will offer an apology and admit liability, but this is by no means a certainty.

However, if your claim is successful you will get a sum of compensation to reflect the injuries you have wrongfully sustained. It will also help the same mistakes being made in the future. Many people who make a claim say this provides some form of justice. It also helps them achieve a sense of closure, allowing them to put the experience behind them.
