General Practitioner Negligence and How to Make a Claim for Compensation

Can You Sue The NHS For Compensation? If the actions or failings of your GP have left you or a loved one struggling with a poor long-term outcome, contact Glynns Solicitors, specialists in medical negligence law.

General practitioners and medical negligence

General practitioners are, by their very nature, not specialists, and yet they are faced with a wide variety of conditions on a daily basis about which they need to make some form of judgement and decision about the way forward for the patient. Some conditions are easily diagnosed. Others are not. Some conditions may be a medical emergency. Others are not. Some require an onward referral and others do not.

Occasionally a condition is misdiagnosed, a referral is delayed, safety-netting is missed. An examination may be insufficient or the significance of a symptom may not be realised.

When to make a claim

If the consequences of such a scenario are that the patient suffers a worse long-term outcome than should have been the case with an appropriate level of care, the patient is legally entitled to make a claim for compensation.

A successful compensation claim will address the financial losses experienced by the patient as a result of the negligence.

For example, in some circumstances, a patient's capacity to work may be restricted by the consequences of the negligence, leaving them struggling with a reduced income. The associated losses would be included in a claim.

Likewise, if the patient now requires specialist care or equipment and treatment, the associated costs could also be included in a successful claim.

How to make a claim

If you think you might have a claim, the first step is to talk to a legal specialist.

It is important that you do this as soon as possible so that you don't miss any of the deadlines associated with this complex procedure.

A specialist solicitor will be able to investigate the quality of your medical care and advise you as to whether or not you have a valid claim.

If so, they will make a further assessment of the ways in which the negligence has affected your health, well-being and quality of life and judge the associated financial losses.

They will guide you through the processes and steps to making a claim and, where necessary, negotiate the best settlement.
