Gallbladder Negligence and When to Make a Claim for Compensation

Can You Sue The NHS For Compensation?Contact Glynns Solicitors if you or a loved one are struggling with the consequences of negligent gallbladder surgery. A successful claim will help to tackle the challenges caused by your negligent care.

Medical negligence in gallbladder surgery

Gallbladder surgery is so common and usually so successful that it is easy to imagine that errors do not occur. Occasionally, however, a mistake does happen and the consequences can be life-changing.

A surgical procedure to remove the gallbladder can, in fact, be extremely complicated. The relevant anatomy around the gallbladder and the bile duct may not always be easily identified, local structures may restrict the field of view and it is in such circumstances that mistakes can happen.

Working within a laparoscopic or 'keyhole' environment, can further complicate the procedure and a part of the biliary system can be damaged. For example, the bile duct may be inadvertently obstructed or cut.

Alternatively, another nearby part of the abdominal anatomy may be damaged unintentionally.

Without a prompt and effective response, the patient's health may deteriorate rapidly.

When to make a claim for compensation

You may be able to claim medical negligence compensation if the health and well-being of yourself or a loved one has been significantly compromised by negligent medical care in the course of gallbladder surgery. Where this is found to be the case, following a thorough analysis of your medical records, a successful claim would address the problems caused by the negligence.

For example, if you have suffered a loss of income, or require specialist equipment or treatment or care due to the effects of the substandard care, your solicitor would include the associated financial losses and costs into your claim.

Remember, however, that the initial investigation into your medical care can be time-consuming and has to be carried out before the claims deadline of three years from the date of the negligence.

If you think that you may have a claim, contact a specialist solicitor at the earliest possible moment in order to initiate this assessment of your care.
