Femoral Nerve Medical Negligence and When to Claim Compensation

If you have suffered accidental or negligent nerve damage during a surgical procedure which has left you with significant symptoms which you would not have suffered but for the negligence, you are legally entitled to make a claim for compensation.

The impact of femoral nerve damage

Damage to the femoral nerve, running from the spine, through the pelvis and into the legs, can leave a patient suffering with loss of mobility which, inevitably, will affect almost every aspect of their life. They may no longer be able to undertake their usual form of employment, thereby suffering a loss of income. They may need equipment to assist them in mobilising. They may need their home to be altered in order to navigate safely around it. Driving may be difficult, incurring further costs for the patient. The psychological impact can be severe.

The patient's family will also be affected as they may need to provide care and support on an on-going basis.

A successful compensation claim will address any financial losses caused by the negligent medical care, such as a reduced income or the costs of care where necessary.

When to claim compensation

You can make a claim for compensation if two things are evident:

  • Firstly, it must be considered that there has, in fact, been an act of negligence or a breach of duty in the course of your medical care
  • Secondly, that the negligent care has caused damage and symptoms which would not otherwise have been the case

It is also important to be aware that compensation claims for medical negligence are associated with a three year deadline. A claim must be issued with a court within three years of the date of the alleged negligence. Before this deadline, a specialist solicitor will need plenty of time in which to assess the quality of your medical care and its impact, if any, on you and your quality of life.

Speak to a legal specialist

If you think you or a loved one may have a claim, speak to a legal specialist. They will have the experience to investigate your claim and, where appropriate, to negotiate with the Defendant to achieve the best outcome.
