Episiotomy Claims

If you have had an episiotomy that was either performed or repaired in a negligent fashion, you may be able to make a medical negligence compensation claim. But when does an episiotomy amount to medical negligence? How do you know if you are entitled to compensation? And how do you begin the claims process?

Episiotomy and Medical Negligence

An episiotomy is an incision made to the perineum during the second stage of labour. It is not performed by way of routine, and should only be carried out if medical professionals believe it will assist with the delivery of the baby.

While an episiotomy is designed to help childbirth, there are unfortunately occasions in which complications occur due to the negligence of medical professionals. This will usually be because the cut was negligently performed, or because it was negligently repaired. We will look at each of these in closer detail:-

1. Episiotomy was negligently performed

When performing an episiotomy, the doctor or the midwife should use a sharp instrument to make a small, diagonal cut. This is called a medio-lateral episiotomy, and is safer than cutting straight downwards. However, the medical professional responsible for making the incision may fail to provide an acceptable standard of care. Such negligence can arise for a number of reasons, such as:-

  • A blunt instrument was used;
  • It was not a medio-lateral episiotomy;
  • The incision caused internal damage (for example, sphincter damage);
  • An episiotomy was not actually necessary.

2. Episiotomy was negligently repaired

Once the baby has been delivered, it is important for a mother to undergo an examination to ensure all damage is immediately identified. An episiotomy can then be repaired, which will involve suturing the cut together with dissolvable stitches. However, if the wound is not stitched properly, a mother will go on to suffer complications such as pain and sexual dysfunction. Negligent stitching that leads to problems such as this is a common source of episiotomy claims.

Making an Episiotomy Claim

If you believe you have been the victim of episiotomy negligence, you need to find out whether or not you are able to make a claim. This best way to do this is to contact a lawyer who specialises in this area of law. All it takes is a short consultation, after which a medical negligence solicitor will be able to assess the details of your case before advising you on your legal position. If you are indeed able to make a claim, your solicitor can guide you on the process involved, beginning the claims procedure on your behalf.
