Disability and Compensation for Negligent Medical Care
If poor-quality medical care has left you disabled and struggling to work or remain independent, a successful compensation claim may help you to address some of your difficulties.
The right to compensation for negligent medical care
The law entitles an individual to claim compensation if they or a loved one have suffered as a result of negligent medical care. If the quality of the care received has caused the patient to suffer a worse outcome than would have been the case with an acceptable level of care, they can claim compensation for the impact of that negligence.
If, for example, a patient has been left disabled by their negligent care and are unable to work as a result of their disability, they can claim compensation for their financial losses, past and future, in so far as they have been caused by the negligence.
Disability and medical negligence
Negligent medical care can occasionally leave an individual severely disabled. This may extend beyond mobility losses to include sight or hearing loss, cognitive impairment, bowel incontinence, balance difficulties plus a range of other difficulties. The following are a few examples of how such a shocking scenario can occur:
- Compression of or damage to a nerve during surgery, thereby compromising the patient's mobility
- Perforation of the bowel, leading to sepsis and disabling symptoms
- Delayed diagnosis of cauda equina syndrome, allowing the patient to suffer incontinence and loss of mobility
- A 'never event' causing permanent damage to the patient
- A failure to diagnose a heart condition or pulmonary embolism, leading to permanent disability
Disability and financial losses
An individual who has been disabled by negligent medical care may struggle to work and find that they are facing a severely reduced income. They may find that they require personal care or alterations to their home and struggle with the costs of this situation.
If these circumstances are the outcome of substandard care, it may be appropriate to consider making a claim for compensation which would incorporate such financial losses.
