Delayed Diagnosis of Infective Endocarditis and Compensation Claims
The early symptoms of this rare and terrible condition can be difficult to diagnose but a failure to consider this diagnosis may prove catastrophic for the patient, even fatal. It may be appropriate to make a claim for compensation.
Suspecting infective endocarditis
The key to a good outcome is an early suspicion by medical professionals as to the possible cause of the patient's symptoms followed by prompt action to investigate and confirm the underlying causes.
The possible complications of infective endocarditis are likely to worsen with a delay in diagnosis and treatment. They are wide-ranging including the possibility of a stroke occurring, the possibility of heart failure developing as a result of this bacterial infection.
Medical negligence in relation to infective endocarditis may include the following:
- A failure to recognise the possible symptoms leading to a delay in referrals for further investigation and a delayed diagnosis
- A failure to assess or consider the patient's history and pre-existing conditions which might put them at a high risk of infective endocarditis. This would include patients who are already suffering from a heart condition.
- A misinterpretation of test results or a delay in treatment, allowing the patient's condition to deteriorate leading to a worse outcome than would have been experienced with more prompt and appropriate care
Where a patient survives infective endocarditis, the long-term outcome can, nonetheless, be life-changing, depriving the patient of their independence and capacity to work.
Where medical negligence has contributed to this outcome, it may be possible to make a claim for compensation.
Making a claim for compensation claim
A successful compensation claim will take account of financial losses as well as the pain and suffering experienced. Losses such as a reduced oncome or the costs of care would be addressed as well as the pain and suffering of the patient.
However, it is important to remember that claims for compensation need to be initiated within three years of the date of the alleged negligence.
Do not delay in obtaining specialist legal advice if you or a loved one are struggling with the effects of infective endocarditis due to substandard medical care.
