Compensation for Cervical Myelopathy Diagnosis Negligence

Cervical myelopathy can be a progressive, degenerative condition which, untreated, can leave the patient permanently reliant on a wheelchair. A failure to suspect this condition as a possible diagnosis may be regarded as negligent.

The impact of degenerative cervical myelopathy

Cervical myelopathy is caused by degeneration in the cervical region of the spine in the neck. Over time, this degeneration can start to cause compression of the nerves and associated dysfunction or complete loss of function.

Without diagnosis, and treatment, the degree of function loss may increase, rendering the patient disabled.

Function losses associated with cervical myelopathy include the following:

  • Loss of manual dexterity, making it difficult to carry out a wide range of tasks such as holding items, manipulating cutlery and driving
  • Loss of mobility, causing imbalance and risk of falls, difficulty walking and eventually reliance on a wheelchair. Such symptoms can deprive an individual of their independence, making them reliant on care, as well as hindering their ability to work, travel and carry out household tasks.

An individual with cervical myelopathy may also experience pain and stiffness in the neck, as well as possible incontinence due to the pressure on the nerves.

Diagnosis and treatment

A prompt diagnosis is fundamental to a good long-term outcome for the patient. However, diagnosis requires a willingness to consider this devastating condition as a possible explanation for the patient's symptoms. A failure to do so may mean that the patient does not receive the necessary MRI scan which can assess the condition of their cervical spine.

Symptoms which might suggest that the patient may be developing cervical myelopathy could include pins and needles in the hands, stiffness or numbness in the limbs, pain in the neck and changes in balance or gait when walking.

Prompt diagnosis and treatment to reduce the compression in the cervical spine can enable significant recovery of function and reduction in symptoms.

Medical negligence

A failure to recognise or consider the possible implications of a patient's symptoms may be regarded as negligent. A failure to refer a patient for the necessary investigations which could diagnose their condition may be regarded as substandard care.

If the patient suffers unnecessary long-term problems as a result of their negligent treatment, it may be appropriate to make a claim for compensation.
