Claiming Compensation for Negligent Post-operative Care
A patient who is recovering from surgery requires skilled and careful attention for signs or symptoms that something is wrong. When this does not happen, the outcome can be catastrophic and may justify a claim for compensation.
Post-operative medical care
Following major surgery, a patient is in a vulnerable condition. Their body is trying to recover from the trauma of the operation and the impact of anaesthesia and establish some sense of bodily function, independence and normality. - Any indication that the surgery has been unsuccessful needs prompt attention and may require that the patient returns to theatre for corrective surgery
- Signs of haemorrhage and falling blood pressure can threaten the brain and the survival of the patient if there is a delay in diagnosis and treatment
- A patient who has undergone abdominal or rectal surgery needs to be monitored for any suggestion that they have suffered a bowel perforation as a result of their operation and may need immediate attention
- Problems resulting from postural or operative negligence during surgery, such as compartment syndrome or nerve damage, need to be diagnosed promptly to avoid permanent disability
Claiming compensation for medical negligence
A failure of medical care in the hours following surgery can quickly lead to a critical situation and cause the patient ling-long difficulties.
If a patient suffers significant problems as a result of substandard medical care which would not have been the care with more appropriate care, they are entitled to make a claim for compensation.
