If a patient suffers negligent medical care which causes them to experience a worse outcome than would have been the case with a competent level of care, the law entitles them to make a claim for compensation.
A medical negligence claim cannot undo the harm that has been caused. However, it will give you a chance to obtain some form of justice. It will also provide you with financial redress for the physical, emotional and financial damage incurred by you and your family as a result of the negligence.
The occurrence of negligence in itself is not necessarily sufficient to justify a claim for compensation. It is necessary to be able to show that the negligence has adversely affected the patient's outcome.

Severe medical negligence
Many minor incidences of negligence probably occur which make little difference to the patient's outcome and of which the patient may not even be aware.
Occasionally, however, a negligent act by a medical professional can have an absolutely catastrophic impact on the patient's life, limiting their capacity to work, damaging their emotional well-being and depriving them of their long-term independence.
Examples of such severe negligence could include the following:
- A 'never event' such as an incorrect amputation
- A delay in the diagnosis of cancer, allowing the disease to spread
- Accidental bowel perforation, causing sepsis and long-term health problems
- A failure of surgical method or procedure, leaving the patient with life-threatening infection or the need for reconstructive surgery
- A failure to assess a new mother for anal sphincter damage, leaving her to suffer permanent bowel incontinence
- A failure to prevent or to diagnose spinal compression, allowing nerve damage to deprive the patient of significant nerve function and causing long-term disability
- Surgical failings, causing hearing or vision losses
