Claiming Compensation for C-Section Medical Negligence
A caesarean section to deliver a baby is usually a safe and successful operation, producing a positive outcome for both mother and baby.
Occasionally, however, this potentially complicated procedure can go wrong and the new mother may have to struggle with the consequences.
If this distressing outcome is the product of negligent medical care, it might be appropriate to make a claim for compensation.
Infection after a C-section
If a new mother develops infection due to negligent care during a caesarean section, the consequences can be significant.
The infection may trigger sepsis which can be cause the mother to become extremely unwell, leaving her with on-going symptoms and difficulties. This immune system dysfunction can also be life-threatening.
If extremely unlucky, the woman may even develop necrotising fasciitis, a soft-tissue infection which can develop where there is an incision in the skin. This appalling infection causes the decay of all the tissue it infects and can leave an individual struggling with disability and deformity. This appalling infection is a medical emergency and any delay in diagnosis and treatment may be life-threatening.
Damage during surgery
The complex anatomy in the vicinity of the womb is also susceptible to damage during a caesarean section.
- A nerve may be inadvertently damaged during the procedure to deliver the baby, causing long-term difficulties and loss of function
- A nearby organ such as the bladder may be accidentally damaged during a caesarean section. If this destructive occurrence is not identified and the damage repaired at the time of the birth, it may leave the new mother with significant on-going problems.
Claiming compensation
If a new mother experiences negligent care during a caesarean section, causing long-term problems, she may be able to make a claim for compensation.
Severe health complications such as sepsis and necrotising fasciitis can cause a dramatic reduction in health and quality of life. It can reduce a woman's capacity to care for herself and her baby, destroy her self-confidence and limit her capacity to work.
Where the negligence can be demonstrated to have caused the financial losses, these costs can be incorporated into a successful claim for compensation.
