Charcot Foot Disability and When to Claim for Compensation for Negligence

Charcot Foot Disability and When to Claim for Compensation for NegligenceCharcot foot can cause severe disability. If this distressing situation is due to negligent medical care, it may be possible to make a claim for compensation.

What is charcot foot?

Charcot foot is a condition where often serious damage to the foot develops, causing disability and sometimes requiring amputation, due to lack of sensation and awareness of injury.

It is a condition which is often associated with people who are suffering from diabetes and who may have reduced sensation in the foot.

Careful and knowledgeable medical attention is required to identify this debilitating problem and ensure that the patient undergoes the appropriate treatment.

Medical negligence and charcot foot

Examples of negligent medical care which may result in a poor patient outcome could include the following:

  • A failure to understand the significance of the patient's diabetes and to recognise that the patient may be developing charcot foot
  • A misdiagnosis of the patient's symptoms
  • A failure to refer the patient to an appropriate specialist
  • Arranging inappropriate treatment for the patient's condition

Why make a claim for compensation?

A successful claim for compensation is not only a matter of recognising the pain and suffering which the patient has had to endure. In financial terms, a successful claim would also incorporate any losses which the patient has experienced as a result of the negligence on their health and well-being. For example, if they are no longer able to work due to their disability, their financial losses would be included in the claim insofar as they were caused by the negligence. The same is true of any costs of personal care, if such is needed.

However, for many of our clients, initiating a claim is about finding out what went wrong, receiving an acknowledgement that they have been the victim of negligence and hoping that this process will mean that other people do not suffer the same experience.
