Can I Get Compensation for an ERCP Injury?
Perforation of the digestive tract during an ERCP can cause catastrophic and life-changing effects. If you have suffered in this way, it may be appropriate to make a claim for compensation.
How does an ERCP cause injury?
An ERCP is an invasive surgical procedure used to check the condition of the upper digestive tract. Using a tube with a miniature camera attached, medical professionals can assess the state of the patient's bile duct, pancreatic duct and upper end of the small intestine (the duodenum).
The tube is inserted via the mouth and travels down the oesophagus and through the patient's stomach to reach its destination.
The possibility of unintentional injury to the patient's digestive tract during this procedure is recognised and perforation of the tract seems to occur in approximately 1% of patients.
Should this occur, it becomes a medical emergency.
A medical emergency
Once a tear has been made at some point of the digestive tract, bacteria can leak from inside the digestive system into the patient's abdomen on retro-peritoneal space. Unless this situation is quickly diagnosed and effectively treated, the patient may develop peritonitis, a serious infection, and risks further developing sepsis, a dysfunctional immune system response to infection.
It can ultimately threaten the life of the patient.
Some patients may make a good recovery but, of those who survive, many may find that their long-term health has been compromised by their experience and they may struggle both physically and psychologically.
Sepsis can cause multiple organ failure and the patient may be left with poor kidney function, for example, or post-sepsis syndrome affecting their concentration levels, their cognitive functioning, their sleep patterns and their confidence.
Medical negligence
Accidental injury during ERCP should not occur. If it does, it should be repaired promptly and effectively.
If this does not occur, and the patient suffers significant long-term injuries and problems, it may be appropriate to make a claim for compensation.
