Can I Claim Medical Compensation on Behalf of Someone Else?
An individual who has suffered a poor outcome and compromised quality of life due to negligent medical care is legally entitled to make a claim for compensation. Can someone else make a claim on their behalf?
Claiming on behalf of someone else
There are a number of circumstances where it might be appropriate to make a claim for compensation but where the immediate victim of the medical negligence may not be able to pursue the claim themselves. In these circumstances, it might be possible for a third party to make a claim on their behalf.
Examples of where this might be possible include the following:
- Acting on behalf of a minor who has been the victim of negligent medical care
- Acting on behalf of an individual who does not have mental capacity, whether due to the negligent medical care or due to a pre-existing condition
- Acting on behalf of a deceased person's estate
- Acting as the dependant of a deceased person, where the individual has suffered as a result of the death of the deceased person
Making a claim for compensation
Compensation claims for medical negligence can be extremely complex and this may be especially so where the claimant is not the person who has suffered the negligence directly.
If you believe that a loved one or another third party has been the victim of medical negligence but, for whatever reason, may not be able to pursue a claim in person, it would be best to seek the advice of a medical negligence legal specialist.
In order to pursue a claim for compensation, it is necessary to ascertain that there was indeed a breach of duty in the quality of an individual's care and that it caused the individual to suffer adverse consequences which would not have been the case with an acceptable level of care.
An experienced specialist is the best person to carry out this assessment for you. They will have both the expertise to negotiate with the Defendant as well as having access to the best medical experts who will analyse the quality of your care.
