Can I Claim Compensation for a Medical Never Event?
If a 'never event' in medical care has left you or a loved one struggling with on-going symptoms, it may be possible to make a claim for compensation.
The right to claim compensation
If a patient suffers a worse long-term outcome after negligent medical care than would have been the case with competent care, they are legally entitled to make a claim for compensation.
A successful compensation claim will take account of the patient's pain and suffering as well as their financial losses.
For example, if a patient is no longer able to work due to the effects of their negligent medical care, their loss of income would be included in a claim in so far as it has been caused by the negligence. If the patient suffered other financial losses, such as care costs, these would also be included in a compensation claim.
Impact of a 'never event'
The impact of a 'never event' will depend entirely on the nature of the error. 'Never events' vary in nature from misadministration of a drug, to carrying out a surgical procedure to the wrong part of the body or leaving medical equipment inside the patient's body following the procedure.
A patient may be left with limited mobility or suffering severe bowel problems or struggling in a myriad of other ways.
The long-term effect may restrict the patient's ability to work. It may even affect their ability to remain independent in their own home.
If a compensation claim is successful it will reflect the degree of disability and its on-going impact.
Making a compensation claim
In the early stages of making a claim, a specialist solicitor will need to access your medical records and, in conjunction with a medical expert, assess whether or not a 'never event' occurred and what impact it has caused.
If an error is found to have been made by medical professionals, an experienced solicitor will be able to negotiate the best settlement on your behalf.
