Assessing Medical Negligence and Your Financial Losses

Assessing Medical Negligence and Your Financial LossesIf you or a loved one have been the victim of negligent medical care, talk to a specialist solicitor about investigating the quality of your care and, where appropriate, the value of your financial losses.

Assessing the quality of medical care

Before a claim for compensation can be submitted to a court, it is necessary for an investigation into the quality of the claimant's medical care to be carried out. This process requires a specialist solicitor to obtain copies of all the relevant medical records and to employ the services of the best and most respected medical experts to analyse the quality of your care.

The purpose of this is to identify whether or not there appears to have been an act of negligence or a breach of duty in the course of the patient's medical care. This may occur in any aspect of care from the GP surgery, to NHS 111, Accident and Emergency or in-hospital care.

It may relate to failures of examination or diagnosis, referral delays, testing failures, risk assessments and substandard surgical procedures amongst many other processes which may occur during medical care.

Assessing your financial losses

If it is found that you have suffered from a breach of duty and that your poor long-term outcome from medical care has been adversely affected as a result, your specialist solicitor will make an assessment of your related financial losses.

This will include any loss of earnings, insofar as these have been caused by the negligence, as well as any additional costs of care or equipment or treatment necessary to manage your symptoms and challenges.

Such financial losses would be included in a successful claim as well as a recognition of your general pain and suffering.

When to make a claim

It is important to bear in mind that your claim needs to be submitted to a court within three years from the date of the alleged and that the above assessment of your care needs to be carried out before this deadline.

You should speak to a specialist solicitor at the earliest possible moment in order to get the investigation into your care under way.
