Work Accident Leads To Toe Injury

Mrs H of Gloucester was changing an electric timer in her office when a five foot by four foot wooden panel fell away from the wall and landed on her big toe. She experienced immediate severe pain in her right big toe and this severe pain continued for at least a week.

She was able to continue working and to return home, but when she was still in pain two days later she went to see her GP. He thought that she may have chipped a bone but did not believe that an X-ray was necessary. However, when Mrs H returned still in a lot of pain two weeks later he organised an X-ray. This confirmed a transverse fracture of the big toe. Strapping was attempted but this did not help the pain. The hospital advised Mrs H to continue mobilising the big toe.

Constant pain continued for a period of around six weeks and this affected her sleep on a regular basis. Some nine months after the accident she continued to experience discomfort, particularly in cold weather, with an occasional shooting pain under the big toe.

The pain prevented Mrs H from dancing and horse riding for several weeks after the accident.

We negotiated a total settlement of £4,000 in settlement of her claim for compensation. We ensured that our client kept all of her compensation and negotiated settlement of our legal costs from her employer's insurance company. Note - the law changed in April 2013 so that this may no longer be the case for claims made after this date.
