Slipping Accident At Work
We were instructed by a lady called Lucy in her early 30s who sustained a soft tissue injury to her non-dominant left wrist as a result of slipping on some water at work that had leaked out of a freezer.
We sent a letter to Lucy's employer approximately five months after the accident had taken place. An admission of liability was received approximately four months later, subject to Lucy accepting a reduction of 25% for contributory negligence. This was because Lucy was the manager of the store at the time of the accident and ought to have been aware that the freezer was leaking and done something to correct the situation.
After obtaining documentary evidence, we advised Lucy that the chances of her being found 25% to blame for her accident were slim, but that there was a significant risk that she might be found 10% - 15% to blame if the matter were to go to trial.
Lucy fortunately made a good and relatively swift recovery from the soft tissue injury, although her wrist was kept in a splint for seven weeks or so after the accident.
She did not have to take any time off work as a result of her injuries and the symptoms that she experienced after the first five – six months were both intermittent and mild and were expected to fully resolve by our own medical expert.
The claim was settled for the sum of £2,300.00 exactly two years after the accident had taken place.
