Head Injury Caused by Falling Pallets

Tim was working as heavy goods driver when he was asked to help a colleague move some storage bins. A forklift driver was already assisting in the task, although some of the bins had accidentally fallen off his truck. Tim began to pick them up, but as he did so more fell on top of his head, causing him to suffer a nasty injury.

After delivering a batch of dashboards to a car manufacturing plant, Tim was nearly at the end of his shift, and so returned in his lorry to the yard. He set about his last few duties, unloading the empty frames and heading to the office to complete some paperwork.

However, Tim was then asked to work a little longer, as there was a large quantity of storage bins that need to be relocated. These bins, which had sat in the yard for several years, were to be moved to another location just two minutes drive away. Tim agreed to help, so went out into the yard where his colleague was already loading a trailer with a forklift truck.

The bins, which measured approximately 40 metres by 80 metres by 20 metres, were staked on wooden pallets in batches of ten. Nevertheless, they were not secured to the pallet, but simply had shrink wrap fitted around the circumference. It was for this reason that a number of them had fallen off the forklift truck and scattered all across the floor.

This in turn was hindering the loading process, so Tim took it upon himself to clear a path for the truck. He picked one up before shifting to the nearside of the trailer to move another. However, at the same time the fork lift driver was loading another pallet when the unsecured bins once again slid off. Unfortunately, Tim was positioned directly underneath the pallet, meaning the bins landed on top of his head.

He fell to the floor, aware of a severe pain in his head and a large amount of blood gushing from the top of his head. An ambulance was quickly called and Tim was rushed to A&E where a three and a half centimetre gash in his head was stitched up.

After the accident, Tim remained off work for the next week and for some months suffered from headaches, pains in his neck and shoulder, restricted mobility and a disturbed sleep pattern.

This was not, however, the first time Tim had been caused injury while under his employer's care. The previous year he had sustained another serious head injury, calling into question the safety of his employment. As a result, Tim decided it would be best to discuss his accident with Glynns.

We agreed that Tim's employers had failed to create a safe working environment. There were no health and safety signs displayed in the yard, which was always cluttered and untidy. We helped Tim make a work accident claim, and he received £3,000 compensation.
