Lower Back Strain Injury Claim
Glynns were asked to help Belinda who suffered a lower back strain whilst in the process of unpacking some large boxes of produce from a roll cage at work. Belinda contacted Glynns within approximately three weeks of her accident taking place at which point she continued to suffer from symptoms in her back. We obtained full details of the accident from Belinda and shortly afterwards we contacted her employer.
The basis of her claim was that the employer had failed to provide Belinda with any or any adequate manual handling training and, amongst other things, had failed to carry out a suitable or sufficient assessment of the risks to our client (and indeed her fellow workers) of the manual handling task that she was performing at the time of her injury.
The employer's insurance company soon accepted that their insured was responsible for the accident and Belinda's injuries.
Approximately eight months after her accident she was seen by an orthopaedic consultant to confirm the extent of her injuries. He concluded that whilst she had made a decent recovery she still had some ongoing symptoms. The expert advised that the ongoing symptoms had brought forward symptoms that Belinda would have experienced anyway due to problems with Belinda's back that had pre-existed her accident. In his view, the symptoms had been brought forward by approximately two years.
We also obtained a report from a consultant psychiatrist due to the stress related symptoms that Belinda had experienced in the months after her accident. The psychiatrist confirmed that as a result of the accident Belinda had suffered from what is known as a “Adjustment Disorder” which lasted briefly and for a period of approximately three months.
Belinda was happy to accept a final settlement offer in the sum of £5,600 for her lower back injury claim.
