Timing in medical negligence claims

It is important to remember that there is a legal limit regarding the timing of a compensation claim for medical negligence. If an individual suffered a poor outcome from necrotising fasciitis or fournier's gangrene due to substandard medical care in January 2018, they need to commence their claim for compensation within three years, being January 2021.

A delay in initiating treatment in the form of surgical debridement in a patient with necrotising fasciitis may prove fatal. This swift-moving infection causes tissue death and a delay in treatment may increase the spread of the infection and put the patient at risk of death or amputation.
