Negligent Surgery and Compensation for Necrotising Fasciitis

If negligent medical care has caused you to suffer a worse outcome than would have been the case with an acceptable quality of care, you are legally entitled to make a claim for compensation.

Surgery and the threat of necrotising fasciitis

Necrotising fasciitis is a virulent infection which is associated with a high mortality rate. It requires meticulous and prompt medical care. A failure of care may be regarded as negligent and may justify a claim for compensation.

This appalling infection often develops where a wound or injury allows bacteria to access the subcutaneous tissue. This means that a surgical procedure can put the patient at risk and that scrupulous care is necessary before, during and following surgery.

  • If the patient is considered to be at risk of infection, prophylactic antibiotics may be necessary and, where this does not take place, leaving the patient vulnerable to infection, it may be regarded as a case of negligence
  • Any signs or symptoms of necrotising fasciitis or of infection in general require close attention following surgery and a failure to suspect this appalling illness may allow the patient to suffer terrible symptoms. Symptoms which might be indicative of necrotising fasciitis would include pain, swelling and discolouration around a wound. The patient may also exhibiting signs of infection such as a high temperature.

The consequences of negligence in necrotising fasciitis

The devastation which can be caused by this horrific infection is difficult to overstate. Delays in diagnosis and treatment may mean that the patient suffers extensive tissue death. The medical response is the removal of all infected tissue, leaving disability, deformity and scarring as the evidence of the patient's shocking experience.

A patient may even need to undergo an amputation of an arm, leg or fingers in order to prevent the further spreading of the infection.

The long-term impact on a patient's life can be devastating affecting a person's ability to work and to remain independent.
