Negligent Soft-tissue Infection Care and When to Claim Compensation
If you have suffered from negligent care of necrotising fasciitis, it may be possible to claim compensation.
Deadly infection
Necrotising fasciitis is a soft-tissue infection with the capacity to kill. Causing the decay of all the tissue it infects, and putting the patient at risk of developing sepsis, this horrific illness can lead to multiple organ failure and the death of the patient.
Even where the patient survives, they may suffer permanent scarring, deformity, disability and, when the infection affects the limbs, as is often the case, they may even require a full or partial limb amputation.
Necrotising fasciitis requires scrupulous, knowledgeable and timely medical care and is considered to be a medical emergency due to the speed with which it can spread through the body and the extent of damage which it can cause.
Negligent care can cause a catastrophic outcome and may justify a claim for compensation.
The following may be regarded as examples of negligent medical care in relation to this most appalling of infections:
- A failure to provide prophylactic antibiotics to a patient at risk of this terrible infection
- A failure to monitor a patient who has recently undergone an invasive surgical procedure
- A failure to recognise the possible symptoms of necrotising fasciitis such as swelling, redness and tenderness as well as intense pain, particularly in the region of a cut or injury to the skin
- A failure to refer a patient with possible symptoms for specialist investigation
- A delay in initiating treatment in the form of debridement of all infected tissue
When to claim compensation
In order to make a claim for compensation, it is necessary to demonstrate both at there has been an act of negligence or breach of duty in the course of the patient's care, and that the negligence has caused the patient to suffer a worse outcome than would have been the case with an acceptable level of care.
A specialist solicitor will be able to obtain the relevant medical records and investigate the quality of the patient's medical care and, if there has been a breach of duty, the impact which this has had on the patient.
A successful compensation claim would address the financial losses caused by this outcome such as a loss of income due to disability or other symptoms.
