Necrotising Fasciitis Infection Negligence and Claiming Compensation
A necrotising fasciitis infection can prove fatal. Even those who survive this shocking illness are likely to experience permanent and life-changing disability. If medical negligence has contributed to such a poor outcome, it might be possible to make a claim for compensation.
What constitutes negligent care of necrotising fasciitis?
A necrotising fasciitis infection is a medical emergency. A failure to diagnose, leading to a delay or failure of treatment, can lead to the death of the patient. At best, any delay is likely to cause the patient to require more treatment in the form of surgery and to suffer more debilitating symptoms as a consequence. Necrotising fasciitis often commences in the legs and severe cases may require an amputation to halt the further spread of the infection.
- A failure to recognise or at least suspect the symptoms of necrotising fasciitis leading to a misdiagnosis may be regarded as negligent
- A failure to examine a patient for signs of necrotising fasciitis may be regarded as negligent
- A failure to make a timely referral, allowing the patient’s condition to deteriorate, may be regarded as negligent
- A delay in initiating surgical debridement, allowing the patient to suffer worse permanent symptoms may be regarded as negligent
When Can I Claim Compensation?
You can claim compensation when it is clear that a medical professional has provided substandard or negligent care and where that poor-quality care has caused you to suffer symptoms and difficulties which would not have been the case with an acceptable level of care.
It is also important to bear in mind that a claim for compensation has to be initiated within three years of the date of the alleged negligence. For example, if you suffered a delay in diagnosis and treatment of necrotising fasciitis in February 2020 and have been unable to work since then as a result, your claim needs to be initiated by February 2023. Your solicitor will need plenty of time before that date to investigate the validity of your claim.
