When Can I Get Compensation for CES Clinical Negligence?
You should be able to claim compensation for clinical negligence in relation to cauda equina syndrome if it is found that your medical professionals were guilty of a breach of duty in the course of your CES care, and that the negligence caused you to suffer symptoms which would not otherwise have been the case.
What is CES?
Cauda equina syndrome is a serious condition of the spine where a herniated disc or other cause of inflammation or pressure in the lumbar region, causes the cauda equina nerves to become squashed or compressed.
This, in turn, causes reduction or loss of nerve function, leaving the patient with symptoms such as incontinence of bowel and bladder, loss of sexual function and reduction or loss of mobility.
In order for the patient achieve the best outcome, an early diagnosis and prompt surgical decompression is necessary. It is often considered to be a medical emergency due to the nature of the possible symptoms.
What is negligent care of CES?
Negligent care of cauda equina syndrome tends to relate to the diagnosis process and the timing of surgery to decompress the nerves. If medical professionals have the opportunity to diagnose the condition at an early stage but fail to do so, the patient's condition may deteriorate in the intervening time before surgery is finally carried out.
Failings which might lead to a delay in diagnosis and surgery could include the following:
- A failure to recognise the possible symptoms of cauda equina syndrome
- A failure to carry out appropriate tests to identify signs of cauda equina syndrome
- A failure to make a timely referral for an MRI scan
- A failure to arrange an MRI scan within an appropriate, often emergency, timeframe
- A failure to provide a patient with the necessary red flag warnings of what symptoms to look out for and when to attend Accident and Emergency
When to claim compensation
If you are considering making a compensation claim relating to clinical negligence and cauda equina syndrome, you need to consult a specialist solicitor at the earliest moment. CES compensation claims are extremely complex and your solicitor will need to carry out a thorough investigation of the quality of your care before they can issue your claim. The deadline for this is three years from the date of the alleged negligence.
