Symptom Compensation and Cauda Equina Syndrome Negligence

Symptom Compensation and Cauda Equina Syndrome Negligence Speak to Glynns Solicitors about making a claim for compensation if you are suffering with disabling symptoms and suspect that your cauda equina compression may have received negligent medical care.

Symptoms of cauda equina syndrome

The symptoms of cauda equina syndrome are pretty shocking and can be utterly life-changing.

Where negligent medical care has contributed to this distressing outcome, a successful compensation claim will not only address the patient's pain and suffering, but will also take account of the impact of their symptoms.

Depending on the extent of the nerve compression and associated function losses, possible symptoms can include the following:

  • reduced mobility or paralysis
  • loss of control of the passing of wind and faeces
  • loss of bladder sensation and control
  • loss of sexual function and sensation

if this appalling cocktail of symptoms has been adversely influenced by negligent medical care, a claim for compensation would consider the ways in which your symptoms have affected you quality of life and caused you to suffer significant financial losses and costs.

For example, if your symptoms mean that you are no longer able to work in the same job, or have to work reduced hours or can no longer work at all, your loss of earnings would be included in your claim.

If you need specialist equipment or treatment or household adaptations in order to manage your disabling symptoms, the associated costs would be included in your claim as would the costs of care if this were necessary.

Negligent medical care

Negligent medical care in relation to cauda equina compression can include a failure of examination, a failure of diagnosis, a delay in making a referral for an MRI scan and a failure to provide adequate red flag advice.

Any of these can cause a delay to occur in achieving a correct diagnosis and undergoing surgery. Unfortunately, cauda equina compression is often a matter of emergency and a delay can allow the patient to suffer a worse outcome due to increased nerve compression.

If it is found both that an act of negligence has occurred and that it has caused a worsening of the patient's long-term outcome, it may be possible to make a claim for the consequences.
