Cauda equina syndrome is a fairly rare condition of the spine which affects the functioning of the lower body. Many doctors may only occasionally encounter it in their patients and yet it is imperative that, if a patient attends with the possible symptoms of this disabling condition, the right care is provided.
A delay in diagnosing cauda equina compression can be utterly life-changing and such a delay may commence in the GP surgery when a patient arrives complaining of lower back pain. They may additionally be experiencing altered sensation in both legs, altered sensation in the saddle area and altered urinary and bladder function.
If a GP has any doubts or suspicions about their patient's condition or diagnosis, a referral for specialist assessment is essential.
If the GP fails in this or fails to make a timely referral for an MRI scan, they may be regarded as having been negligent in their care of the patient.
This may also apply if the GP fails to provide the patient with the necessary red flag warnings of what symptoms should prompt their immediate attendance at hospital.
Compression of the cauda equina nerves can worsen over time and a delay in diagnosis and treatment can allow time for both the nerve compression and the loss of associated function to worsen considerably.
If surgery to decompress the nerves is delayed, the patient may face a lifetime of double incontinence, loss of mobility and sexual dysfunction.
Claiming compensation for cauda equina syndrome negligence
If a patient suffers the disabling long-term symptoms of cauda equina syndrome due to failings on the part of their GP, they may be entitled to claim compensation for the consequences of that negligence.
For example, the patient's capacity to work may now be restricted to an extent that would not have been the case had their GP provided more appropriate, timely or knowledgeable care. If this is the case, a successful compensation claim would take account of the financial losses suffered by the patient.
