Negligent GP Delay in Diagnosing Cauda Equina Syndrome

The timing of both diagnosis and treatment of cauda equina syndrome are crucial in determining the outcome for the patient. If your GP has contributed to a delay in diagnosis, it may be appropriate to make a claim for compensation.

GP assessment for cauda equina syndrome

If a GP is faced with a patient who is experiencing lower back and leg pain, it is essential that they consider whether these symptoms may be indicative of cauda equina compression. They should carry out an examination, assess the patient for further symptoms and may need to make a referral for an immediate MRI scan. If this does not appear necessary, the patient may still need to be warned of the red flag symptoms of cauda equina syndrome in case their condition should deteriorate. A failure to do any of this may be regarded as negligent.

If a patient's condition deteriorates prior to diagnosis and surgery, leaving them with long-term problems, it may be possible to make a claim for compensation. Knowing the red flag symptoms

Symptoms which might justify a referral for an immediate MRI scan would include the following:

  • Bilateral sciatica symptoms of pain and altered sensation extending below the knee
  • Weakness in the legs
  • Altered sensation in the saddle area, around the genitals and the buttocks
  • Altered urinary sensation
  • Altered urinary experience such as having to strain to empty the bladder
  • Loss of awareness of needing to defecate

A delay in suspecting cauda equina syndrome and a delay in a referral for an MRI scan will delay a confirmation of a diagnosis of cauda equina compression. This, in turn, will lead to a delay in the commencement of surgery and may mean that the patient suffers a significantly worse outcome than would have been the case with an earlier diagnosis.
