Loss of Mobility and Cauda Equina Syndrome Compensation

One of the many debilitating and distressing features of cauda equina syndrome is its capacity to render an individual unable to walk. Caused by compression of the cauda equina nerves at the base of the spine, this appalling condition can deprive a person of both sensation and movement in the lower limbs, paralysing them.

Alongside its other shocking symptoms of double incontinence and sexual dysfunction, cauda equina syndrome can be utterly life-changing unless it is diagnosed and treated promptly.

Diagnosis

Diagnosis of cauda equina syndrome needs to take place as early in the development of the spinal compression as is possible. This requires a medical practitioner to understand that their patient's symptoms might be indicative of compression of the cauda equina nerves. A thorough examination is necessary to ensure that any possible neurological symptoms, such as altered sensation in the saddle area, are identified. An MRI scan would then be required to clarify whether or not the patient's symptoms are being caused by nerve compression.

Symptoms which might justify an emergency referral for an MRI scan could include the following:

  • Bilateral leg symptoms of pain and altered sensation such as tingling or numbness
  • Altered sensation around the genitals and perineum
  • Altered bladder sensation and awareness of needing to urinate
  • Altered experience when urinating such as having to strain
  • Altered sensation in the bowel and around the buttocks

Treatment

If the clinical assessment and MRI scan indicate that the patient is suffering from compressed cauda equina nerves, they will require decompression surgery at the earliest possible moment. This is to decompress the nerves before the patient's symptoms deteriorate further and become irreversible.

Medical negligence

A failure to carry out any of the above processes can leave a patient with permanent complete cauda equina syndrome and loss of mobility.

The implications of this are wide-ranging. In terms of employment alone, an individual may find that their existing work is no longer suitable or accessible. As a result, they may suffer a considerable loss of income. It may be that they are no longer able to work at all.

Their home may no longer be easy to navigate and daily tasks may require the assistance of personal support.

Making a claim for compensation

If an individual finds that their life has been permanently changed due to loss of mobility following a delayed diagnosis of cauda equina syndrome, a successful compensation claim can provide significant redress.

It should take into account the financial losses and care needs caused by the alleged negligence. For many victims of medical negligence, a successful claim can also provide a sense of justice having been done.
