Clinical Negligence Claims for Cauda Equina Syndrome

Cauda equina syndrome is often caused by a herniated disc in the lumbar region of the back. A failure by medical professionals to diagnose this condition may prove catastrophic for the patient and justify a claim for compensation.

Cauda equina nerve compression

Cauda equina syndrome develops when the cauda equina nerves at the base of the spine become squashed or compressed. This occurrence can be caused by a number of local physical problems, including a tumour, but is often the result of a herniated disc where the central gel-like substance has pushed through the outer layer and is squashing the nerve.

If this situation remains undiagnosed, the long-term effects can be appalling.

The cauda equina nerves are responsible for passing messages of sensation and movement between the lower body and the brain and a loss of function will affect the individual in a myriad of distressing and debilitating ways.

Disability associated with cauda equina syndrome includes the following:

  • Loss of mobility
  • Loss of perineal sensation and sexual function
  • Double incontinence

Delayed diagnosis of a herniated disc

Diagnosis of a herniated disc needs to be confirmed with an MRI scan. Due to the progressive nature of cauda equina syndrome, a herniated disc needs to be diagnosed at the earliest possible moment. This will enable medical professionals to arrange surgery to decompress the nerve and prevent further loss of function.

If the symptoms presented by the patient such as lower back and leg pain and possible altered saddle sensation are misdiagnosed, a referral for an MRI scan may be delayed.

If the patient suffers a deterioration of their condition during the period of delay, meaning that their long-term outcome from surgery is worse than had diagnosis been achieved earlier, it may be possible to make a claim for compensation.

How to Claim Compensation

Claiming compensation for medical negligence requires a solicitor to access your medical records in order to assess the quality of your care. They will need to instruct the best medical experts in the relevant field who can identify whether or not a breach of duty has occurred and, if so, how this has affected you.

If you think you may have been the victim of negligent medical care and are struggling with the on-going impact, your first step is to speak to a specialist solicitor.
