Compensation for MRI Delays in Cauda Equina Syndrome Diagnosis
A timely MRI scan and prompt, accurate results are crucial to the diagnosis of cauda equina compression and cauda equina syndrome. This is key to initiating the decompression surgery which may save the patient from a lifetime of disability.
The role of the MRI in cauda equina compression diagnosis
The symptoms of cauda equina syndrome may indicate that a patient is suffering from compression of the nerves at the base of the spine. However, an MRI scan is essential in order to confirm the underlying cause of the patient's symptoms. If indeed their cauda equina nerves are being compressed, such as by a herniated disc, they may need emergency surgery to decompress the nerves.
This demonstrates the role the MRI scan has to play in this process. If the referral is delayed or the scan is misinterpreted, the patient may then find that they do not undergo surgery at the point when it would have been most effective, their symptoms may deteriorate before an accurate diagnosis is made and they may then go on to suffer long-term symptoms which would not have been the case with an earlier confirmed diagnosis.
Negligent medical care related to the MRI scan in the diagnosis of cauda equina syndrome can include the following:
- A failure to make an appropriate referral for an MRI scan
- A failure to refer a patient for an MRI scan at all when it would normally have been considered as appropriate
- A delay in carrying out an MRI scan
- A failure to transfer an emergency patient to a facility where a scan would be available
- A misinterpretation of MRI scan results, causing a delay in the commencement of surgery
Claiming compensation
Delays in the diagnosis and treatment of cauda equina syndrome can leave a patient disabled for life. They may struggle to work, they may need personal care and they may require significant alterations to be carried out to their home in order to be able to function safely.
The costs associated with these circumstances can be considerable. If such an appalling outcome is associated with the consequences of negligent medical care of the patient, it may be possible to make a claim for compensation. A successful claim would take account of these unexpected costs and financial losses.
