Compensation for Impaired Bladder Function due to CES

Compensation for Impaired Bladder Function due to CES

The shocking long-term physical impact of cauda equina syndrome does not appear to be widely-known. This appalling condition is a medical emergency and a failure to treat it as such may prompt a claim for compensation.

Bladder function and CES symptoms

One of the debilitating effects of cauda equina syndrome is the reduction or complete loss of bladder function. Compression of the cauda equina nerves needs to be diagnosed early in order to ensure that surgery is carried out before the nerve function deteriorates.

A patient whose cauda equina nerves have been squashed by, say, a herniated disc, is likely to find that they start to experience urinary symptoms. This might present as poor flow or having to strain to commence or complete urination. It may be a reduced sensation of needing to urinate or less awareness of the experience of urinating. The patient may suffer leakage of urine.

These are indications, along with lower back and leg pain, that the cauda equina nerves may be suffering and that the patient may require an emergency MRI scan to assess their lower back.

Loss of bladder function can cause considerable distress and practical problems. If the patient is suffering from complete cauda equina syndrome, they may also be experiencing bowel incontinence, sexual dysfunction and impaired mobility as well.

This appalling cocktail of permanent symptoms can render the patient dependent on care and unable to work. The financial implications can be considerable.

If such a distressing and debilitating outcome is the result of medical delays in either diagnosis or surgery, it may be appropriate to make a claim for compensation.

Medical negligence

  • A failure to recognise the possible early symptoms of cauda equina syndrome leading to a delay in a referral may be regarded as negligent
  • A failure to warn a patient with lower back pain of the red flag symptoms of cauda equina syndrome may also be regarded negligent
  • A delay in organising either an MRI scan or surgery may be regarded as negligent
