Compensation for Cauda Equina Clinical Negligence

- A misdiagnosis of symptoms may cause a life-changing delay, leading to an accusation of negligence
- A delay in making a referral for a crucial MRI scan will delay a confirmed diagnosis and may allow the patient to suffer an increase in compression and a deterioration in symptoms before surgery is carried out
- A delay in undertaking an MRI scan or a failure to transfer a patient to appropriate facilities for a scan when necessary may be regarded as negligent
- A failure to provide a patient with the necessary red flag warnings may lead to a delay in diagnosis and be regarded as negligent
- A delay in initiating surgery for confirmed cauda equina compression may lead to a claim for compensation if the patient suffers a worse outcome than would have been the case with more timely surgery
Cause for a claim for compensation
The law allows that, if substandard medical care leaves a patient with a worse outcome than should have been the case if they had experienced competent and appropriate care, the patient is entitled to compensation. This should restore them financially to the position which they would have enjoyed but for the negligence.
For example, if a patient is no longer able to work because of their disabling physical symptoms caused by negligent care, they can claim compensation for those financial losses.
If the individual requires personal care and support because of their negligent symptoms, such costs would be incorporated into a successful compensation claim.
