Compensation For Missed Cauda Equina Syndrome
Diagnosis failings are usually the cause of cauda equina syndrome compensation claims where the patient has been left with a lifetime of disability.
Assessing cauda equina syndrome symptoms
When someone suffering with possible early symptoms of cauda equina syndrome attends their GP, it is essential that a thorough assessment is undertaken in order to clarify whether an emergency MRI scan is necessary.
The patient may be suffering with lower back pain and symptoms of pain and tingling in one or both legs but the GP should also check for signs of the following:
- Tingling or loss of sensation around the anus and between the legs
- Alteration in bladder and bowel habits
- Alteration in sexual sensation
- Numbness in the legs
- Weakness of the ankle reflexes or signs of foot drop
These could all be signs that the patient is beginning to experience neurological problems due to compression of the cauda equina nerves at the base of the spine. If that is the case, the patient is likely to require emergency surgery to resolve the compression before the symptoms deteriorate and the chances of recovery diminish.
If the patient has symptoms of incomplete cauda equina syndrome (where they still retain bladder sensation), an emergency MRI scan will probably be necessary in order to establish the underlying cause of the symptoms.
Medical negligence
If a GP, or A & E practitioner, fails to make a thorough assessment or fails to recognise the possible implications of the patient's existing symptoms, they may be regarded as having provided substandard care.
If a GP, when faced with such symptoms, fails to make the appropriate referral, they may be considered to have been negligent.
If the patient subsequently suffers a significantly worse outcome because the delay in diagnosis allowed their condition to deteriorate, it may be sensible to make a claim for compensation.
